These Terms of Service (the “Agreement”) spell out what rights you have with respect to the use of the Service. Please read it carefully. We have a privacy policy which outlines how we handle your data here. This Agreement is entered into effect when the User first invites the Service into their own server, or upon their first use of the Service. If you do not agree to the Agreement, please stop using the Service. At any time do we reserve the right to update these Terms with reasons including, but not limiting to adhering to new legal requirements, or improving your experience using Overseer. If the aforementioned changes affect your usage of Overseer or your legal rights, we may notify you no less than seven days before the changes take effect. Unless we state otherwise, your continued use of the Service after we post modifications will constitute your acceptance of and agreement to those changes. If you object to the changes, your recourse shall be to cease using the Service.

Service Availability and Quality

We are constantly evolving the Service to improve it for the end user. The Service is subject to modification at any point in time, including but not limited to the features available to the User, the internal logic behind commands and cosmetic display of content. No guarantees are made towards the Service’s quality, uptime, stability or reliability. The Service is provided to the User on an “AS IS” BASIS, WITHOUT WARRANTIES OR CONDITIONS OF ANY KIND, either express or implied, including, without limitation, any warranties or conditions of TITLE, NON-INFRINGEMENT, MERCHANTABILITY, or FITNESS FOR A PARTICULAR PURPOSE. You are solely responsible for determining the appropriateness of using the Service and assume any risks associated with use of the Services. Overseer’s developers reserve the right to suspend or ban your access to the Service at any time, and for any reason. You may not reverse engineer the Services or the Assets. You may not use automated tools to access or interact with the Service. Only one user may use the Service per registered account. Each user of the Service may only have one account. We reserve the right to investigate complaints or reported violations of our Terms of Service and to take any action we deem appropriate including but not limited to reporting any suspected unlawful activity to law enforcement officials, regulators, or other third parties and disclosing any information necessary or appropriate to such persons or entities relating to user profiles, e-mail addresses, usage history, posted materials, IP addresses and traffic information.

Age Requirements

By accessing the Service, you confirm that you’re at least 13 years old and meet the minimum age of digital consent in your country. If you are old enough to access the Service in your country, but not old enough to have authority to consent to our terms, your parent or guardian must agree to our terms on your behalf. Please ask your parent or guardian to read these terms with you. If you’re a parent or legal guardian, and you allow your teenager to use the Service, then these terms also apply to you and you’re responsible for your teenager’s activity on the Services

Your Information

By using the Service, you may provide Overseer with personal information like your user name and ID, the entire content of the message that invoked a command, role IDs and guild IDs. Payment and Billing

We may invoice you for your use of the Service through a third party payment service provider. The third party service provider’s terms of service shall govern and supersede this Agreement in case of conflict. You are free to cancel your plan at any time. We also reserve the right to terminate your access to the Service for any reason, including for violation of the Community Guidelines or other inappropriate use of the Service. Upon cancellation or termination, any outstanding usage fees will be charged immediately. You will not be refunded for the current pay period, and it is up to you to cancel the subscription.

Community Guidelines

  1. Be respectful to one another, especially when answering questions asked by beginners unfamiliar with the bot, regardless of how basic the question is.
  2. Racism, sexism, homophobia, etc. will not be tolerated. This list is non-exhaustive, so be careful of what and how you say things, but by all means, political, philosophical and controversial discussions are welcome as long as they’re informative and not blatantly rude.
  3. Avoid being a general nuisance to others through your tone, choice of words and general attitude towards people.
  4. Moderators can take action at their own discretion if they see fit, our rules serve as a guide towards what we see appropriate, though we cannot realistically cover everything, so use your common sense.

Limitation of Liability and Indemnity

We provide the service as is, and we make no promises or guarantees about it. You understand and agree that we will not be liable to you or any third party for any loss of profits, use, goodwill, or data, or for any incidental, indirect, special, consequential or exemplary damages, however they arise. You are responsible for your use of the service. If you harm someone else or get into a dispute with someone else, we will not be involved.

Miscellaneous

  1. Force Majeure. Neither party will be liable for failure or delay in performance to the extent caused by circumstances beyond its reasonable control, including acts of God, natural disasters, terrorism, riots, or war.
  2. No Agency. This Agreement does not create any agency, partnership, or joint venture between the parties.
  3. Severability. If any part of this Agreement is invalid, illegal, or unenforceable, the rest of the Agreement will remain in effect.
  4. No Third-Party Beneficiaries. This Agreement does not confer any benefits on any third party unless it expressly states that it does.
